4. Our lawful bases for using your information
Data protection law requires us to have a lawful basis for using your personal information. Depending on what we are doing, we rely on:
Contract. Where we need your information to quote for work, agree a contract with you, carry out the work, invoice you or deal with anything arising from it.
Legitimate interests. Where we have a genuine business reason and it does not override your rights. This covers things like responding to enquiries, keeping records of jobs and decisions, keeping photographs of completed work, protecting our website, recovering unpaid invoices and dealing with disputes.
Legal obligation. Where the law requires it, including tax and accounting records, health and safety records, and information we have to give to building control or another authority.
Consent. Where we ask for it, such as non-essential cookies, or using identifiable photographs of your property in our marketing. You can withdraw consent at any time and it will not affect anything done before you withdrew it.
5. Marketing
We do not buy marketing lists and we do not sell your information to anyone for marketing.
If we send you anything promotional it will be because you have asked us to, or because you are an existing customer and it relates to similar work. Every marketing message will have an unsubscribe option, and you can also just ask us to stop.
Asking us to stop sending marketing does not stop us contacting you about work we are doing or have done for you.
6. Cookies
This website uses cookies and similar technologies. Some are needed to make the site work; others help us understand how the site is being used.
Where the law requires it, we ask for your consent before setting non-essential cookies, and you can change your mind at any time.
Our Cookie Policy sets out what we use and how to control it: www.nikaconstruction.co.uk/cookie-policy
7. Who we share your information with
We share personal information only where there is a reason to, and only as much as is needed. That may include:
-
Subcontractors and trades working on your job, who need the address, the access arrangements and the scope of work;
-
Suppliers and merchants, for deliveries to site;
-
Skip, plant and muckaway contractors, including on waste transfer documentation;
-
Structural engineers, surveyors and designers involved in your project;
-
Building control, and any other authority that has to inspect or approve the work;
-
Water and utility providers, where a connection, capping or build over agreement is needed;
-
Party wall surveyors, where the Party Wall etc. Act 1996 applies;
-
Our accountant and bookkeeper;
-
Our insurers and, if ever needed, our legal advisers;
-
Our website, email, file storage and analytics providers;
-
Payment providers and our bank;
-
Police, HMRC, a court or a regulator, where we are legally required to provide it.
We do not sell personal information, and we do not share it for anyone else's marketing.
8. Transfers outside the UK
Some of the everyday services we use, such as email, file storage and website analytics, are provided by companies that may store or process information outside the UK.
Where that happens we rely on the safeguards UK data protection law allows, such as adequacy regulations, the UK International Data Transfer Agreement, or standard contractual clauses with the UK addendum.
9. How long we keep it
We keep personal information only for as long as we actually need it. As a guide:
-
Enquiries that do not become jobs: up to 2 years from your last contact with us;
-
Quotations that are not accepted: up to 2 years;
-
Customer and job records, including photographs, survey notes and correspondence: for the duration of the job and then up to 6 years, which matches the period in which a contract claim can usually be brought;
-
Records relating to structural work, foundations, drainage or anything covered by building control: up to 15 years, because claims relating to building work can be brought later than ordinary contract claims;
-
Accounting and tax records: at least 6 years, as HMRC requires;
-
Health and safety records: as long as the relevant regulations require;
-
Marketing contacts: until you unsubscribe or ask us to delete them;
-
Website analytics: according to the retention setting of the analytics provider.
We may keep information longer where there is an unresolved dispute, an insurance claim, or a legal reason to.
10. How we protect it
We take reasonable technical and organisational steps to keep personal information safe. These include password protection and multi-factor authentication where available, keeping records in reputable cloud services rather than loose on devices, limiting who can see what, and asking subcontractors to keep customer information confidential.
No website, email account or online service can ever be completely secure, and we cannot guarantee the security of information you send us over the internet.
11. Photographs of your property
We photograph work as we go. That is partly a record for your benefit and ours — a schedule of condition before we start, what was found when something was opened up, what was done before it was covered over — and partly for our own portfolio.
-
Photographs taken as a record of the work are kept as part of the job file, under section 9.
-
We will not publish photographs that identify your property, your address or you personally without asking you first.
-
If we have used a photograph with your permission and you later change your mind, tell us and we will take it down from anywhere we control.
12. Your rights
Depending on the circumstances, you have the right to:
-
Ask what personal information we hold about you and get a copy;
-
Ask us to correct anything inaccurate or incomplete;
-
Ask us to delete information, where there is no good reason for us to keep it;
-
Ask us to restrict how we use it;
-
Object to us using it, including for marketing;
-
Ask for a copy in a portable format, where the right applies;
-
Withdraw consent where we relied on consent;
-
Complain to the Information Commissioner's Office.
To use any of these rights, email info@nikaconstruction.co.uk or write to us at the address above. We may need to check who you are before we respond. We will reply within one month, and will tell you if we need longer.
There is no charge unless a request is clearly unfounded or excessive.
13. Complaints
If you are unhappy with how we have handled your personal information, please tell us first so we can try to put it right.
You also have the right to complain to the UK's data protection regulator:

15. Children
Our website and our services are aimed at adults and are not directed at children. We do not knowingly collect personal information from children. If you think a child has sent us personal information, contact us and we will delete it.
16. Changes to this policy
We may update this policy from time to time. The current version will always be on this page with the date it was last updated. If we make a significant change we will make that clear.
